Country Schedule — Malawi

This Schedule applies if you registered in Malawi.

Read it with the GetZuga Master Services Agreement. That document holds the terms that are the same in every market; this one holds what is specific to Malawi. Where the two differ, this Schedule wins for your market — and where either conflicts with a law that protects you, that law wins.


1. Who you are contracting with

GETZUGA LOGISTICS LIMITED, company number COY-YJU4GG6, a private company limited by shares incorporated in Malawi, of 39 Chizumulu Road, Area 44, Lilongwe.

2. The law and the courts

Malawi law governs your agreement.

The courts of Malawi hear any dispute. We have deliberately not sent you to a foreign court: a Malawian rider contracting with a Malawian company should be able to bring a claim at home, and we would rather that than a clause that looks strong and may simply be unenforceable where you live.

3. Your rights under Malawi law

Malawi law gives you rights as a consumer, and nothing in this agreement or in the Master Services Agreement is intended to reduce them.

Where a term in either document goes further than Malawi law allows, it applies only as far as that law allows, and the rest of it still stands. That includes any limit on our liability.

We cannot exclude liability for death or personal injury caused by our own negligence, for fraud, or for our gross negligence. Section 12 of the Master Services Agreement says so, and it applies here.

4. How you can pay

Cash, paid to the driver directly. That money passes from you to the driver and never reaches us.

GetZuga Wallet, which in Malawi holds promotional credit we issue at our own cost. It is not money we hold for you, it cannot be exchanged for cash, and it can only be used in Malawi.

Airtel Money and TNM Mpamba are not available yet. Each needs an agreement with the network, and when either is in place we will say so.

Prices are shown in Malawi kwacha (MK), and the price you are shown is the amount you pay.

5. The drivers, and what we check

Carrying passengers for reward in Malawi requires a driver's licence and a public service vehicle permit. The documents we ask for depend on the kind of vehicle — a bicycle taxi is not asked for the same paperwork as a minibus.

We ask every driver for the documents their vehicle type requires, and for an identity document, before we approve them. A driver who has not provided them is not approved.

What we do, stated exactly: we collect those documents and a person looks at them. We do not verify them against the authority that issued them, and we do not screen drivers for financial crime. We would rather tell you what our check is than let the word "verified" do work it has not earned.

That last part is deliberately not repeated here. Which GetZuga company decides how your information is used is set by an agreement between the two companies, and it can change. Describing it in two places is how the two come to disagree, so the Privacy Policy is the one to read and the one we keep accurate.
